Please read these Terms carefully. By creating an account, signing in, or otherwise using the CityCard app, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.
These Terms are written in English. A Norwegian translation may be provided for convenience; if there is any conflict, the English version prevails, except where mandatory Norwegian consumer law (forbrukervernlovgivning) requires otherwise. Nothing in these Terms limits your non-waivable rights as a consumer under Norwegian law.
1. About CityCard and these Terms
The CityCard app (the “App”) is provided by CITYCARDNORWAY AS, a company registered in Norway with organisation number 931 042 211 and registered address at Årstadgeilen 31, 5009 Bergen, Norway (“CityCard”, “we”, “us”, “our”).
CityCard is a digital city-pass and discount service. The App helps tourists and residents discover venues in and around Bergen and unlock discounts, deals and offers at participating partner venues (museums, attractions, restaurants, transport providers and similar). These Terms govern your use of the App and the related services (together, the “Service”).
2. Eligibility and your account
- You must be at least 18 years old to purchase a pass. Users under 18 may use the App only with the consent and involvement of a parent or guardian, who accepts these Terms on their behalf.
- You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You may enable Face ID / fingerprint protection in the App for added security.
- You are responsible for activity that takes place under your account. Tell us promptly if you believe your account has been accessed without your authorisation.
How we handle your personal data is described in our separate Privacy Policy, which forms part of your agreement with us.
3. Passes, offers and how the Service works
A CityCard pass gives you access to discounts and offers at participating partner venues for the period stated at purchase. The specific offers, venues, discount levels and validity periods are shown in the App and may change over time.
- Offers are subject to availability and to each partner venue’s own conditions (for example opening hours, capacity, seasonal closures, or one-redemption-per-visit limits).
- Some offers may require you to present a valid, activated pass at the venue, or to scan an offer/QR code in the App.
- We work to keep venue and offer information accurate, but we do not guarantee that any particular venue, offer or discount will be available at any given time.
4. Prices, payment, currency and VAT (MVA)
- Prices and currency. Prices are shown in the App in Norwegian kroner (NOK) and/or euro (EUR), as applicable to your store and region. The price shown at checkout is the total price payable.
- VAT / MVA. Prices include Norwegian value-added tax (merverdiavgift, “MVA”) where applicable, at the rate in force at the time of purchase. Your receipt will reflect any MVA charged.
- How payment is taken. Purchases are made as in-app purchases through the Apple App Store or Google Play and are managed via our payments partner, RevenueCat. Your payment is processed by Apple or Google under their own terms; we do not receive or store your full card or bank details.
- Subscriptions and renewal. If your pass is sold as an auto-renewing subscription, it will renew automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. You can view, manage or cancel a subscription at any time in your Apple App Store or Google Play account settings.
- Price changes. We may change prices for future purchases or renewals. For subscriptions, we will give you advance notice through the App or the app store, as required, and where the law requires we will ask you to confirm before a materially higher price applies.
5. Right of withdrawal (angrerett) and refunds
Because a CityCard pass is digital content/services supplied electronically, special rules under the Norwegian Right of Withdrawal Act (angrerettloven) apply.
5.1 Your 14-day right of withdrawal
As a consumer buying at a distance, you normally have a 14-day right of withdrawal from the day the contract is concluded. If your pass has not been activated or used and the 14-day period has not expired, you may withdraw from the purchase and receive a full refund. To withdraw, contact us at support@citycardnorway.com (you may use the standard withdrawal form in the Act), or request a refund through the relevant app store.
5.2 When the right of withdrawal is lost
Under section 22(n) of angrerettloven, the right of withdrawal does not apply to digital content delivered electronically once delivery/performance has begun, where you have given your express prior consent to begin and have acknowledged that you thereby lose your right of withdrawal. Accordingly, when you activate, download, redeem or otherwise begin using your CityCard pass within the 14-day period, you expressly consent to immediate performance and acknowledge that your right of withdrawal is lost from that point. The App will ask you to confirm this before your pass is activated. We will also confirm your purchase and this acknowledgment on a durable medium, such as by e-mail or an in-app receipt.
5.3 Refunds
- Unactivated passes, within the 14-day window: full refund.
- Activated/used passes: no statutory right of withdrawal, as explained in 5.2, although your mandatory rights for faulty or misdescribed digital services are unaffected (see section 8).
- Because purchases are processed by Apple or Google, refunds are generally issued through the relevant app store. We will help you with eligible refund requests — contact support@citycardnorway.com. Where an eligible refund cannot be processed through the app store, we will arrange it directly.
6. CityCard is a facilitator — partner venues are responsible for their services
Please read this section carefully. CityCard acts only as an intermediary and facilitator. We connect you with participating partner venues and enable discounts and offers; we do not provide, and are not responsible for, the underlying goods, services, experiences, admissions or transport offered by partner venues.
- Each partner venue (museum, attraction, restaurant, transport provider, etc.) is solely responsible for the goods and services it provides, including their quality, safety, availability, accuracy of description, and compliance with applicable law.
- Your use of a partner’s goods or services is a separate contract between you and that partner and is subject to the partner’s own terms and conditions.
- Any complaint, claim, injury, loss or dispute relating to a partner’s goods or services must be raised with that partner. We will, where reasonable, help put you in contact with the partner.
This does not exclude any liability we may have for our own Service, and nothing in this section removes rights you have under mandatory Norwegian consumer law.
7. Acceptable use
When using the Service, you agree not to:
- use the App for any unlawful, fraudulent or harmful purpose;
- copy, resell, share or commercially exploit passes or offers except as expressly permitted;
- attempt to bypass redemption limits, manipulate offers, or gain unauthorised access to the Service or its systems;
- upload content that is illegal, infringing, offensive, or that you do not have the right to share; or
- interfere with or disrupt the App, our servers, or other users’ enjoyment of the Service.
We may suspend or terminate access for serious or repeated breaches of these Terms (see section 12).
8. Our responsibility to you
We will provide the Service with reasonable skill and care. As a consumer, you have mandatory rights under Norwegian law — including the Act on the supply of digital services to consumers (digitalytelsesloven) — if the digital service is faulty or not as described; nothing in these Terms limits or excludes those rights, or our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
Subject to the above, and to the extent permitted by law: we are not responsible for the goods or services of partner venues (see section 6); we do not guarantee that the App will be uninterrupted or error-free; and we are not liable for indirect or consequential losses, or for losses that were not reasonably foreseeable. The App is otherwise provided on an “as available” basis.
9. Intellectual property
The App, the CityCard name and logo, and all related content (excluding partner content and your own content) are owned by CityCard or our licensors and are protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own, non-commercial use in accordance with these Terms. Your own uploaded content is addressed separately in section 10 (User content).
10. User content
Parts of the App let you upload or submit content — for example a profile photo, or images and information relating to a venue or offer (“User Content”). You remain responsible for your User Content.
By submitting User Content, you confirm that:
- you own it, or have all rights, licences and permissions needed to submit it and to grant the licence below;
- it does not infringe the intellectual-property, privacy or other rights of anyone else;
- it is not unlawful, defamatory, offensive, misleading or otherwise in breach of these Terms; and
- it does not contain another person’s personal data unless you have their permission to share it.
You keep ownership of your User Content. You grant CityCard a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt and display your User Content only as needed to operate and provide the Service (for example, showing your profile photo to you, or a venue image within the App). This licence ends when you delete the relevant content or your account, except for copies we are required to keep by law or that have already been shared in accordance with these Terms.
We do not routinely review User Content, but we may remove or refuse any User Content that we reasonably consider breaches these Terms or applicable law, and we may suspend or terminate accounts that repeatedly do so (see section 12).
11. Changes to the Service and to these Terms
We may update, improve or change the App and the Service from time to time. We may also update these Terms — for example to reflect new features, partners or legal requirements. If we make material changes, we will give you reasonable advance notice (for example, an in-app notice) before they take effect. Your continued use of the Service after the changes take effect means you accept the updated Terms; if you do not accept them, you should stop using the Service and may delete your account.
12. Suspension, termination and account deletion
- You may stop using the Service and delete your account at any time in the App (Profile → account settings). Deleting your CityCard account does not automatically cancel an app-store subscription — cancel that separately in your store settings.
- We may suspend or terminate your access if you materially breach these Terms, or where we are required to do so by law. Where appropriate and lawful, we will give you notice and an opportunity to remedy the breach.
- Termination does not affect any refund rights you have already acquired, or any rights and obligations that by their nature should survive (such as sections 6, 8, 9, 10 and 13).
13. Complaints, governing law and disputes
13.1 Contact us first
If something has gone wrong, please contact us at support@citycardnorway.com so we can try to resolve it quickly.
13.2 Consumer dispute bodies
If we cannot resolve your complaint, as a consumer you may ask the Norwegian Consumer Authority (Forbrukertilsynet) to mediate free of charge; if mediation does not resolve the matter, it can in most cases be brought before the Consumer Disputes Committee (Forbrukerklageutvalget) for a decision. Marketing and contract terms are additionally subject to the Norwegian Marketing Control Act (markedsføringsloven), supervised by Forbrukertilsynet.
13.3 Governing law and venue
These Terms and any dispute arising out of or in connection with them are governed by Norwegian law. The agreed legal venue is Hordaland tingrett (the district court for Bergen). This choice of venue does not deprive you, as a consumer, of the protection of mandatory rules — including your right to bring proceedings in the courts of your own place of residence within the EU/EEA where the law so provides.
14. General
Severability. If any provision of these Terms is held to be invalid, unlawful or unenforceable by a court or other competent authority, that provision will be severed and the remaining provisions will continue in full force and effect. Where possible, the severed provision will be replaced by a valid provision that most closely reflects the original intention.
